Speech Acts, Criteria and Intentions What makes a speech act a speech act? Which are its necessary and sufficient conditions? I claim in this paper that we cannot find an answer to those questions in Austin's doctrine of the infelicities, since some infelicities take place in fully committing speech acts, whereas others prevent the utterance from being considered as a speech act at all. With this qualification in mind, I argue against the idea that intentions—considered as mental states accomplishing a (...) causal role in the performance of the act—should be considered among the necessary conditions of speech acts. I would thus like to deny a merely ‘symptomatic’ account of intentions, according to which we could never make anything but fallible hypotheses about the effective occurrence of any speech act. I propose an alternative ‘criterial’ account of the role of intentions in speech acts theory, and analyse Austin's and Searle's approaches in the light of this Wittgensteinian concept. Whether we consider, with Austin, that speech acts ‘imply’ mental states or, with Searle, that they ‘express’ them, we could only make sense of this idea if we considered utterances as criteria for intentions, and not as alleged behavioural effects of hidden mental causes. Knowledge, like other things of value, can be faked. According to Hawley (2011), know-how is harder to fake than knowledge-that, given that merely apparent propositional knowledge is in general more resilient to our attempts at successful detection than are corresponding attempts to fake know-how. While Hawley’s reasoning for a kind of detection resilience asymmetry between know-how and know-that looks initially plausible, it should ultimately be resisted. In showing why, we outline different ways in which know-how can be faked even when (...) a given performance is successful; and in doing so, we distinguish how know-how can be faked (no less than know-that) via upstream and downstream indicators of its presence, and within each of these categories, we’ll distinguish (in connection with detection resilience) both faking symptoms and (various kinds of) criteria. The unappreciated resilience of faked knowledge-how to successful detection highlights a largely overlooked dimension of social-epistemic risk – risk we face not just in our capacity as recipients of testimony, but in our capacity as both (would-be) apprentices and clients of knowledge-how. We may succed in the fulfilment of our desires but still fail to properly own our practical life, perhaps because we acted as addicts, driven by desires that are alien to our will, or as “wantons,” satisfying the desires that we simply happen to have (Frankfurt, 1988 ). May we equally fail to own the outcomes of our epistemic life? If so, how may we attain epistemic ownership over it? This paper explores the structural parallellism between practical and epistemic rationality, (...) building on Williamson’s ( 2002 ) suggestion that we should commence with successful performances as the foundation for both domains, be it action or knowledge. By highlighting the limitations of higher-order regulative approaches in epistemology, exemplified by Sosa ( 2007, 2011, 2015, 2021 ), the paper introduces a form of teleological epistemic constitutivism inspired by Velleman ( 2000, 2009 ). The proposal is that epistemic ownership is not attained in the mere pursuit of truth or knowledge, but requires furthermore a struggle to understand what we know. (shrink)

The aim of this paper is to discuss a basic assumption tacitly shared by many philosophers of mind and language: that whatever can be meant, can be said. It specifically targets John Searle's account of this idea, focusing on his Principle of Expressibility . In the first part of the paper, PE is exposed underlining its analyticity and its relevance for the philosophy of language , mind , society and action . In the critical part, the notion of Background is (...) taken into account in order to re-evaluate two basic distinctions: the one between sentence and utterance meanings , and the one between native and type speakers . PE is reconsidered in the light of the previous arguments as a methodological strategy that does not prevent uses of language from eventual semantic excesses and deficits , and a complementary Principle of Expression Fallibility is finally proposed. Reductive intellectualists (e.g., Stanley & Williamson 2001; Stanley 2011a; 2011b; Brogaard 2008; 2009; 2011) hold that knowledge-how is a kind of knowledge-that. If this thesis is correct, then we should expect the defeasibility conditions for knowledge-how and knowledge-that to be uniform—viz., that the mechanisms of epistemic defeat which undermine propositional knowledge will be equally capable of imperilling knowledge-how. The goal of this paper is twofold: first, against intellectualism, we will show that knowledge-how is in fact resilient to being undermined by (...) the very kinds of traditional (propositional) epistemic defeaters which clearly defeat the items of propositional knowledge which intellectualists identify with knowledge-how. Second, we aim to fill an important lacuna in the contemporary debate, which is to develop an alternative way in which epistemic defeat for knowledge-how could be modelled within an anti-intellectualist framework. According to the standard view, Montaigne’s Pyrrhonian doubts would be in the origin of Descartes’ radical Sceptical challenges and his cogito argument. Although this paper does not deny this influence, its aim is to reconsider it from a different perspective, by acknowledging that it was not Montaigne’s Scepticism, but his Stoicism, which played the decisive role in the birth of the modern internalist conception of subjectivity. Cartesian need for certitude is to be better understood as an effect of the Stoic (...) model of wisdom, which urges the sage to build an inner space for self-sufficiency and absolute freedom. El presente artículo tiene como objeto llevar a cabo un estudio pragmático y analítico sobre la acción de valoración, el valor y los valores a la luz de la ciencia semiótica y de la ciencia cibernética. Por ello, se desarrollará un proceso axiológico que ilustre cómo sucede el ingreso, la transición y la salida de códigos morales en función de un esquema cognitivo. Así pues, el proceso axiológico se postula, primero, en fundamento de tres sistemas: de mentalidad, de valores y (...) de biomoralidad y, segundo, conforme a la teoría de la información y de la teoría general de sistemas. El presente artículo tiene como propósito criticar y reformular la teoría de valores del autor y filósofo argentino Risieri Frondizi. Para ello, se someterán a falsacionismo las tesis según las cuales la cualidad estructural es, primero, estructuralista y no analítica y, segundo, empírica, de acuerdo con la metodología holista de la ciencia. This article presents an explanatory hypothesis regarding an anomalous fact: the omission of complete information but also of the necessary interpretation about the identity traits and specific characteristics of civil society observed in many theoretical and practical contributions in studies on deliberative democracy. The difference between liberal democracy and the deliberative model is blurred when the task of interpreting deliberative practices is relegated or when the approach of critical theory is not applied in the analysis of the material political culture (...) of which deliberative agents are both the architects and the recipients. The hypothesis presented emphasizes the difficulties and systematic rejection generated by the main emancipatory achievements of modern citizens. The resistance aroused by these achievements among prestigious interlocutors of civil society has fueled a sophisticated reactionary rhetoric, which was reported by social science researcher Albert O. Hirschman. At the same time, the explanatory hypothesis used here has a key assumption: the existence of a striking correlation between certain argumentative imperatives and the meager cultural attention that the valuable pluralism observable in deliberative behavior receives today. Even one and the same author may offer more than one definition of what he understands by argumentation: this is partly because the problem of argumentation is not confined to a single area of knowledge or of practical life. Definitions of argumentation are as varied as the different positions taken on the question of what exactly we do when we argue. Even when they are defined with precision, one can often read and hear judgments about the vagueness of heuristics in debates about heuristic reasoning. This opinion is not just frequent but also quite reasonable. El propósito central del presente artículo, es formular un enfoque sistémico-jurídico para el análisis de los sistemas sociales. Para esto, se proponen tres tipologías de consensos denominados límites del sistema social: consenso normal, consenso normativo y consenso legítimo. La función de estas tipologías es, primero elaborar una explicación sobre la constitucionalización y democratización del poder político, con base en la regla de reconocimiento y la norma fundamental de un Estado; segundo postular dos metodologías normativas, un registro positivo y una demarcación (...) positiva, que desplieguen, tanto sobre las conductas sociales como sobre la estructura del sistema social, un proceso de legalidad emergente, cuya función sea, tercero regular, realimentar y optimizar el funcionamiento de la constitución política. Uno de los conceptos fundamentales del área de las Ciencias humanas y sociales es el de «cognición social». Este término se suele utilizar para referir teorías, categorías y principios que explican e interpretan fenómenos relacionados con el conocimiento que los seres humanos poseen sobre el mundo social.

El presente estudio busca describir fenomenológicamente la forma que exhibe la pena en el cuerpo, después de la pérdida de un ser querido. Para esto, se consideran las hipótesis de movimiento centrı́peto orientado a la autoafección, y movimiento centrı́fugo aludido a la ruptura de la intercorpereidad. Ambos movimientos, hacen referencia a la sensación ambigua que el cuerpo vive en la pena asociados a la presencia y ausencia del otro que ya no está, ya que el dolor provee un estado de (...) desincronización temporal que vuelve simultáneos el presente-pasado y presente-futuro. Esto trae como consecuencias, la contracción y extensión del cuerpo a partir de la maleabilidad de sus propios lı́mites. (shrink)

Las definiciones de argumentación son tan variadas como las distintas posiciones existentes en torno a la pregunta de qué hacemos exactamente cuando argumentamos y cuándo estamos, de hecho, argumentando. Incluso el mismo autor puede ofrecer más de una definición de lo que entiende por argumentación; en parte, porque el problema de la argumentación no se circunscribe a un solo ámbito, ni del conocimiento ni de la vida práctica.

El estudio y análisis de las argumentaciones cotidianas entendidas como interacciones discursivas e intencionales encaminadas a dar cuenta de algo con el fin de lograr que aquello que se sostiene sea aceptado, sería inconcebible sin la aparición de la teoría de los actos de habla de Austin (1962), la propuesta de Searle (1969), el trabajo de Grice sobre la teoría de la conversación (1975) y el importante estudio sistemático de Hamblin sobre el argumento falaz (1970). Como una reelaboración de dichas (...) obras cabe entender la teoría pragmadialéctica de la argumentación propuesta inicialmente por Frans H. van Eemeren y Rob Grootendorst (1984). Algunos autores (Blair, 2006: 11; Woods, 1992) creen ver en ella, más que una teoría, una amalgama de varias teorías y una particular versión de la teoría pragmadialéctica de la argumentación, entendiendo ésta bajo una acepción más general. Otros consideran que ni es útil ni tampoco especulativamente productivo sostener que de toda argumentación pueda buscarse un modelo según el cual ésta buscaría resolver una diferencia de opinión (Goodwin, 1999). Our digital society increasingly relies in the power of others’ aggregated judgments to make decisions. Questions as diverse as which film we will watch, what scientific news we will decide to read, which path we will follow to find a place, or what political candidate we will vote for are usually associated to a rating that influences our final decisions.

Concepts as reasonable doubt, cognitive biases and emotions are now a theoretical problem for the practice of law, and the law understood as legal argumentation. From a theoretical point of view, the screenplay written by Reginald Rose, Twelve Angry Men, is an outstanding example to analyze some of these concepts, and its influence on procedural stage. Cognitive biases and informal fallacies are theoretical challenge to legal argumentation.

Der Begriff der Toleranz in der Moderne wurde erdacht mit dem Ziel, Gesellschaften zu organisieren, die sich im Umbruch befanden auf Grund des plötzlichen Eindringens von Glaubensunterschieden in die politische Raumordnung. Die Definition der Toleranz als Tugend, die auf der Nachgiebigkeit gegenüber dem Andersartigen basiert, ist ein Pseudobegriff. Die hermeneutische Veranlagung, die mit der Philosophie einhergeht, zeigt, dass die Toleranz keine schlichte moralische Tugend sein kann, sondern vielmehr eine der Beschaffenheiten der Möglichkeit rationaler Handlungen (die Arten des Seins und des (...) Sagens fallen in der Vielfältigkeit ihrer Formen zusammen). Die Geschichte der Hermeneutik zeigt seit ihren Anfängen – die exegetische Arbeit war hierbei grundlegend – die Zwickmühlen der Existenzformen der Rationalität und lässt nur ein Denken an der Grenze zu, welche ihre Grundlage ist: Es gibt keine Tatsachen, sondern Interpretationen. For Plato mimesis is the appearance of the external image of things. In his view, the reality was not to be found in the world of objects but in the realm of ideas. Therefore, Plato sees the arts as an occupation that is inferior to science and philosophy, but that is also a potential source of corruption. His concept of imitation, although it evolved over time, led him to take an increasingly dogmatic and intolerant position regarding artistic creation. His notion (...) that poetry is morally dangerous establishes the foundations for a didactic critique, which tends to flourish in societies undergoing political crises. Plato wrote his works during an age of instability and decline; an age when the role of Athens as the leading power in the Mediterranean was beginning to be questioned. Through an analysis of Ion and Books II, III, and X of The Republic, this essay explores the epistemological and moral —rather than aesthetic— nature of Plato’s judgment on the value of Poetry and the Arts. En este artículo se analiza el planteamiento de Reinhart Koselleck en torno a la Begriffsgeschichte desde el punto de vista de la productividad de la historia, el tiempo y la productividad propia de la dialéctica de los conceptos. Para ello se traen a colación aspectos muy precisos de la filosofía de Aristóteles, Hegel y Gadamer. La reflexión concluye extrayendo algunas aportaciones que podrían enriquecer la investigación de Koselleck.

‘Reasoning’ can be considered a general concept that, upon speaking, is the ‘enraonar’, a Catalan word that should not be mistaken with ‘explain’ nor with ‘discuss’ which imply more detail, and cover different situations. This article is presented as an essay on the ancient ideal of ‘enraonar’. To that end, it is explained in what sense ‘enraonar’ and reason are one of the most complex phenomena thought has to deal with. Here it is argued that these natural phenomena require a (...) systematic and ‘scientific’ study, and that withoutthis knowledge computer science cannot simulate people’s every-day ‘enraonar’. The objective of this paper is to analyse, from a philosophical perspective, the 16th and 17th Century models of currency, as well as their influence on the types of society in which the models developed. For this, the author values the study by the French philosopher Michael Foucault Words and Things on this matter and the principal foundations of Ludwig von Bertalanffy´s systems theory. The 17th Century model of currency is based on the notion of a system of exchange. The (...) notion of a system of exchange represents a transformation of great significance, upon which the principal characteristics of our current globalised era are founded, not only in economic life, but also in relation to an understanding of the world that it implies. Furthermore, the notion of a system of exchange was the step before the current model of electronic payments of the digital era, in which large transactions (and also large data transfers) take place by pressing a button. The principal idea of the paper is that these economic practices hold the key to deepen a philosophical and historical comprehension of concepts such as globalisation. (shrink)

This paper investigates the differences between ancient Greek and modern ethical naturalism, through the account of the whole classical tradition provided by Cicero in De finibus bonorum et malorum. Ever since Hume’s remarks on the topic, it is usually held that derivations of normative claims from factual claims require some kind of proper justification. It ́s a the presence of such justifications in the Epicurean, Stoic, and Academic-Peripatetic ethical theories (as portrayed in De finibus), and, after a negative conclusion, I (...) argue that we should conceive of this issue within a social-historical perspective: The radical difference between ancient and modern naturalistic ethics is due (in Weber’s terms) to the rationalization processes that generated the modern outlook on nature. "Aranguren: filosofía en la vida y vida en la filosofía" llevó por nombre la exposición sobre la figura y el legado de José Luis L. Aranguren (Ávila 1909- Madrid 1996) que pudo verse desde el 4 de junio al 26 de julio de 2009 en el Pabellón Transatlántico de la Residencia de Estudiantes de Madrid con ocasión del centenario del nacimiento del filósofo abulense.

Benito Pérez Galdós encontró en la clase media una fuente de inspiración para la creación de una novela de costumbres con una destacada dimensión política: describir y hacer comprensibles los problemas de índole moral que hacían muy difícil concebir e implantar un orden social basado en la prosperidad individual y colectiva. Aunque su talante descriptivo, su técnica realista, costumbrista e incluso naturalista, como se ha dicho en alguna ocasión —sin que estemos aquí completamente de acuerdo con ello—,es una de las (...) más sobresalientes de las letras españolas, Galdós nunca renunció al uso de una poderosa voz narrativa con la que imprimió a su literatura un declarado afán de comprensión de la realidad social. El paper realiza una exposición sobre el concepto y contenido de la nulidad y el restablecimiento del derecho como medio de control a la luz de la Ley 1437 de 2011; enfocándola en asuntos ambientales a través del estudio de la licencia ambiental.

Si concebimos el bienestar como condición para que se dé auténtica dignidad en la vida individual y/o colectiva, entre diferentes especies y generaciones de especies, lo cierto es que cabría colegir que la dignidad no tiene una única naturaleza ni, en relación a la que cupiera definir como la más conveniente o necesaria o justa, se instituye conforme a idénticos grados. La (esencia de la) dignidad sería, por consiguiente, relativa. Analicemos esto.

In 1685, in The Art of Discovery, Leibniz set down an extraordinary idea: "The only way to rectify our reasonings is to make them as tangible as those of the Mathematicians, so that we can find our error at a glance, and when there are disputes among persons, we can simply say: Let us calculate [calculemus], without further ado, to see who is right." Calculemus.

In spite of being ubiquitous in life sciences, the concept of information is harshly criticized. Uses of the concept other than those derived from Shannon's theory are denounced as pernicious metaphors. We perform a computational experiment to explore whether Shannon's information is adequate to describe the uses of said concept in commonplace scientific practice. Our results show that semantic sequences do not have unique complexity values different from the value of meaningless sequences. This result suggests that quantitative theoretical frameworks do (...) not account fully for the complex phenomenon that the term “information” refers to. We propose a restructuring of the concept into two related, but independent notions, and conclude that a complete theory of biological information must account completely not only for both notions, but also for the relationship between them. Hume presenta su teoría estética en el ensayo Sobre el criterio del gusto [On the Standard of Taste], en el que propone la existencia de un criterio [standard] capaz de zanjar discusiones de gusto. Ese criterio se basa en la existencia de ciertas formas y cualidades que complacen naturalmente a todo ser humano. Hume asevera que tal criterio corresponde a la opinión del crítico: un hombre que ha desplegado particularmente sus facultades cognoscitivas, lo cual le permite percibir esas finas cualidades (...) que suscitan naturalmente el placer de lo bello en el ser humano. Con respecto a en qué consisten esas formas y cualidades universalmente placenteras, Hume guarda silencio. Pretendo mostrar cómo la teoría de la emoción en la música desarrollada por Leonard Meyer en su texto Emoción y significado en la música (Emotion and Meaning in Music) puede aportar inmensidades en ese aspecto. In Ancient Greece, the figure of the hero was identified as a demigod, possessed of altruistic and virtuous deeds. When Pierre de Coubertin reinstated the Olympic Games, the athlete was personified as a modern hero. Its antithesis, the anti-hero, has more virtue that defects, no evil but he does not care on the means to achieve his goals. In the eyes of everyone involved in sports competition, these characters captivate and at the same time, create conflicts of ethics and aesthetics. (...) The purpose of this paper is to perform an ethical reflection linked to principles that contribute for the human growth and accomplishment, as well as the aesthetic on the perception of the sensitive, reverberated by sensations and feelings emerging from athletes. Connecting the ethic with the aesthetic spheres, we could have in the sports a phenomenon walking toward a common point between moral and aesthetic, between the good and the beauty. (shrink)

In this paper art history and visual studies, the disciplines that study visual culture, are presented as a field whose conjectural paradigm can be used to understand the epistemic problems associated with abduction. In order to do so, significant statements, concepts and arguments from the work of several specialists in this field have been highlighted. Their analysis shows the fruitfulness and potential for understanding the study of visual culture as a field that is interwoven with the assumptions of abductive cognition.

Take the strong rhetoric! This expression comes to mind as we set in order the ideas and impressions prompted by Sandra Harding’s “An Organic Logic of Research: A Response to Posey and Navarro”.

Lorenzo Peña y Gonzalo has developed a logic, a legal philosophy and a political thought of a deeply neo-Leibnizian nature. The neo-Leibnizian mark characterizes both his philosophical thesis and the terms has coined in his contributions to the theory of knowledge, theodicy, ontology, political philosophy, etc. Above all, this mark is present in his conception of Law and of the logic of legal situations.
